Terms of Service

The rules for accounts, listings, transactions, payments, content, and marketplace enforcement.

This draft describes the current test marketplace. It is not yet effective and is not legal advice. It must be reviewed by qualified counsel before Collectors Circle accepts live payments.

1. Operator and acceptance

Collectors Circle is operated by Shawn Clanton, an individual based in Florida. These Terms will govern access to the marketplace when they become effective.

By creating an account or using transactional features after the effective date, you will agree to these Terms and the policies linked from the Policy Center.

2. Eligibility and accounts

  • You must be at least 18 years old and legally able to enter a contract.
  • The initial marketplace is available only to users in the United States.
  • You must provide accurate information, protect your account, and promptly report unauthorized access.
  • One person may not use multiple accounts to evade restrictions, manipulate activity, or mislead others.

3. Marketplace role

Collectors Circle provides technology that helps independent buyers and sellers find each other and complete transactions. Unless a listing expressly says otherwise, Collectors Circle does not own, inspect, authenticate, or take title to listed items and is not the buyer or seller.

We may review, restrict, or remove content and transactions for safety or policy reasons, but we do not guarantee any user’s identity, item authenticity, condition, legality, or future value.

4. Listings and purchases

  • Sellers must have the right to sell each item and must describe its identity, condition, defects, provenance claims, price, and shipping charge accurately.
  • Buyers must review the listing before purchasing and provide a deliverable US shipping address.
  • A listing may be reserved during Checkout. An order is not paid until Stripe confirms payment.
  • Users may not move a transaction off-platform to avoid fees or safety controls.

5. Payments, fees, and payouts

Stripe processes payments and seller onboarding. Sellers must satisfy Stripe's eligibility and verification requirements. Collectors Circle currently charges sellers a service fee equal to 10% of the item price; the stated shipping charge is included in the seller-transfer calculation. Any fee change will apply prospectively and be disclosed before listing or sale.

Seller funds are not released merely because a buyer pays. The platform initiates an eligible seller transfer after delivery is confirmed and may delay, reconcile, reverse, or withhold a transfer where required for refunds, disputes, fraud prevention, sanctions compliance, legal obligations, or technical correction.

6. Shipping, delivery, and returns

The Shipping Policy and Refund Policy are incorporated into these Terms. Sellers are responsible for proper packaging, tracked shipment, and accurate fulfilment information. Buyers are responsible for monitoring delivery and promptly reporting problems.

7. User content

You retain ownership of content you submit. You grant Collectors Circle a nonexclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute that content only as needed to operate, secure, promote, and improve the marketplace. You represent that you have the necessary rights to the content.

8. Prohibited conduct and enforcement

You must follow the Prohibited Items Policy and Community Guidelines. We may investigate reports and restrict listings, content, transactions, payouts, or accounts. Serious or repeated violations may result in suspension or termination and referral to Stripe or authorities.

9. Disclaimers and liability

To the extent permitted by law, the service is provided “as is” and “as available.” Collectors Circle disclaims implied warranties and is not responsible for independent users' conduct or representations. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded. Any final warranty disclaimer, liability cap, indemnity, and dispute language requires attorney review before these Terms become effective.

10. Governing law and changes

These draft Terms contemplate Florida law, without overriding mandatory consumer protections. They do not currently impose mandatory arbitration or a class-action waiver. Material changes will be dated and presented for acceptance when required.
